- LONGA GAMES is a firm belonging to the company SOAR HOLDINGS DRC Sarl, under Congolese law, based in the Democratic Republic of Congo whose head office is based in Kinshasa. Approved by the Ministry of Finance and authorized by the National Lottery Company SA "SONAL SA". We aim to be the leader in technology-based gambling services in French-speaking Africa, here "The Society".
- These Terms and Conditions (hereinafter referred to as the "Terms") apply to the Services offered by the Company. By using Longa Games' SMS or USSD codes, visiting any section of the Company's website and/or opening a lottery and/or instant game account (the "Account") with Longa Games, you (the "User" or "Customer") agree to be bound by these Terms.
- To play at Longa Games and open an account, a person must have reached the minimum age of eighteen (18) years. The Company reserves the right to verify the age declaration of any Customer and to exclude Customers from the Services in case of doubt regarding the achievement of the minimum age requirement.
- The Company reserves the right to modify these Terms at any time and without notice and to publish any changes on the Longa Games Platforms, including the Company's website and hyperlinks.
- You must accept the Terms to access and/or use the Services. Continued access to the Longa Games Platforms and/or use of the Services signifies your unreserved acceptance of these Terms as amended from time to time. If you do not agree to any of the terms set forth in these Terms, you must immediately stop accessing the Longa Games Platforms and using the Services.
1. DEFINITIONS
- "Account" means an account held by a customer in respect of a specific mobile phone number, on the Longa Games Platforms, for the purpose of making registrations and playing at Longa Games;
- "Customer" means the holder of an account, who is eligible to make registrations and whose account has not been terminated, cancelled, suspended or closed and any other person subscribing to the games offered by the Company;
- "Customer Service " means the Company's telephone helpline for Customers, the contact details of which are set out in these Terms;
- "Entry" means an entry made by a customer in relation to a particular game for a particular entry fee and "entries" shall be construed accordingly;
- "Game" means a game available on Longa Games for a particular price and the "Games" should be construed accordingly;
- "Jackpot" means a Game described as a Jackpot by the Company, the Prize of which is an amount to be determined by the Company;
- "CDF" means Congolese Francs, being the legal currency in the Democratic Republic of Congo;
- "Mobile Money" means the mobile money transfer and deposit system concerning a mobile phone number and used by mobile phone networks in the DRC that are compatible with Longa Games such as M-pesa, Orange Money, Airtel Money, Afri Money;
- "Mobile Phone Number" means a mobile phone number registered by a customer in connection with an account;
- "Prizes" means winnings related to a particular game and "Prizes" shall be construed accordingly;
- "Longa Games Platforms" means the Internet systems, computer systems, SMS, USSD codes and any other system used by/on behalf of the Company from time to time to operate the Longa Games Lottery Games, administer accounts, facilitate entries and pay prizes;
- "User" means any person who accesses the Company's website, SMS service, USSD codes or any other Longa Games platform, whether or not they open an account and become a customer. "Users" should be construed accordingly; and
- "Business Day" means any day other than a public holiday or weekend on which banks are open in Kenya; and
- "you" means a user or customer.
2. ACCEPTANCE OF CONDITIONS AND CONSENT TO ELECTRONIC COMMUNICATION
- Acceptance of these terms is signified by your access to a Longa Games platform, the creation of an account or the completion of registrations on Longa Games.
- You agree to receive notices (including all recordings and communications) regarding your account and games from the Company in electronic format, including but not limited to SMS. Such communication shall be deemed to be "in writing" for purposes of these Terms.
- The Company will not send you any paper (paper) copies of any notice, record or communication, unless the Company deems it appropriate. You can obtain a paper copy of its notices, records or electronic communications by printing them.
3. ACCOUNT OPENING
- To open an Account, a person must:
- Have reached the minimum age of eighteen (18) years. The Company reserves the right to verify the age declaration of any Customer and to exclude Customers from the Services in case of doubt regarding the achievement of the minimum age requirement. Any Customer using our Services, identified as a minor, will have all their Prices confiscated and their Account will be immediately blocked;
- Have a valid form of identification
- Have a valid mobile phone number registered with a licensed mobile phone network that would be used to open and manage your account; and/or Have a valid Mobile Money account registered with a mobile phone number that would apply to your account.
- To open an account, you must follow the instructions on the Longa Games platform.
- The Company reserves the right to authorize or refuse an Account opening, depending on its internal procedures.
- Accounts are limited to one account per mobile number.
4. REGISTRATION AND PARTICIPATION IN THE GAMES
- An Entry must be purchased with a ticket. Unless the Admission Ticket is a free Admission Ticket provided by the Company as part of a promotion.
- An entry relating to a particular game must be made before the draw deadline for the game. Any entries made after the designated draw deadline are automatically entered into the next scheduled draw.
- In the event that an entry is received after the announced draw deadline due to a delay in the telephone network, a delay in computer systems or a failure of computer systems or any technical difficulty encountered by the Company, the entry will be entered in the next scheduled draw.
- An Entry will only be valid if it is registered on the Longa Games Platforms. If you do not receive acknowledgement of your registration through your account or any other communication from the Company, you should contact the customer service team for further instructions.
- If you have deposited money into your account to make an entry ticket purchase, but due to technical difficulties affecting the Longa Games platforms, the Company is unable to process your deposit and issue an admission ticket at that time, after rectification of technical difficulties, the Company will process your deposit and issue a participation ticket for the next available draw.
- The Company reserves the right, in our sole discretion, to reject any Entry and/or deny access to the Services and Games to any person, including Customers. Where access to the Services and Games is denied to a Registered Customer, the Company will refund the remaining credit balance of the Customer's Account, using the same payment method provided during registration, or any other payment method subsequently adopted by the Customer after appropriate verification by the Company. If the Account has been closed due to a violation of these Terms or any prohibited or illegal activity, the refund of the remaining credit balance in your Account may be suspended pending investigations by the Company and government authorities and the credit balance may be forfeited.
- Once payment has been validated, You do not have the right to cancel or withdraw an entry and no refund will be given under any circumstances for your purported cancellation or withdrawal of an entry.
- It is your sole responsibility to ensure the security of your account, passwords, admission information and devices (including your mobile phone).
- You indemnify and hold harmless the Company from any claim whatsoever arising from the payment of any cash prize by any method due to third party access to your account or devices.
5. ENTRY LIMITS
- The Company may, at its discretion, impose limits on the number of times you may make Entries during a period (such as daily or weekly Entry limits).
- Any entry limit imposed will be notified to you in such manner as the Company deems appropriate.
6. CLAIM AND RECOVERY OF PRIZES
- Winning entries in a game will be selected by a randomized computerized selection application by the Company. The results of such selections, as communicated by the Company from time to time, shall be final and shall not be subject to appeal or investigation by any Client or any person.
- Only the registered customer, via his registered mobile phone number, who has purchased the winning entry can claim the prize for the respective game. The Company will not pay Prizes to nominees or third parties on behalf of the Client concerned.
- With the exception of Jackpots, all other Prizes, regardless of amount, may be credited directly to your applicable Account, in the absence of a cash payment. You are solely responsible for withdrawing any prize from your account in accordance with these Terms. By depositing the prize amount into your account, you unconditionally release and discharge the Company, its employees, officers, directors, shareholders, agents and affiliates from any and all other claims, actions or demands relating to this prize.
- Jackpot prizes will only be paid to the winner , using a bank account opened by the winner with the Commercial Bank of the Company's choice.
- For all prizes, you will be required to comply with all of the Company's price claim requirements to confirm your identity and your right to the prize to the satisfaction of the Company, in its sole and absolute discretion, including:
- A valid government-issued national identity card or passport;
- Your address;
- any other information that the Company and/or banks will need to confirm your identity and payment of the Prize.
- You agree that the amount of the prize (whether credited to your account or paid in cash) will be made within 7 days. Except for Jackpots prizes which can be up to 15 Days.
- All prizes will be subject to money transfer fees (such as mobile money and bank charges) and all relevant legal deductions, including applicable taxes, duties and other charges payable to government authorities.
- The customer can present himself with his ticket to claim his prize. In the case of online games, winnings are paid directly into the user's account.
- The Company reserves the right to:
- Ask you to visit the Company's offices to claim Your Prize.
- withhold a prize until he is fully satisfied that the entry leading to the prize is valid;
- withhold a Prize (or recover or seek to recover a Prize already paid) until it has completed all appropriate checks and investigations. If, at the Company's discretion, it believes, on reasonable grounds, that you (as the person claiming a Prize) are not legally entitled to receive a Prize or that a Prize has been paid to you in circumstances where the Company determines that the Entry is invalid, or if there is another reason why the Company is challenging the right to the prize, you must immediately reimburse on demand any price that the Company seeks to recover from you.
- Refuse to pay a Prize if you cannot or do not provide the information required by the Company when claiming a Prize.
7. PERSONAL INFORMATION AND MARKETING CONSENT
- By accessing the Services and participating in Longa Games, you expressly consent to the collection, use and disclosure by the Company, its employees, agents and/or service providers of your personal information, for the purposes of conducting, administering and marketing Longa Games.
- The personal information we collect includes:
- Personal and online identifiers (such as names, age, email address, demographic information, or unique online identifiers);
- Information and history regarding your participations, games and prizes;
- Information about the activity of the Internet or other electronic networks using Internet cookies (such as browsing history, marketing preferences);
- Geological location information; and
- Other information about you that is linked to the personal information above.
- You consent to us disclosing your personal information to:
- our subcontractors, authorized assignees and/or third party websites;
- our subsidiaries and affiliates;
- government or court or regulator or law enforcement officials or other third parties to comply with applicable laws or when we believe such action is necessary to comply with applicable law, court order, audit and security requirements, or audit compliance; and
- third parties for marketing purposes.
- You agree that the Company may print, publish, broadcast and use, worldwide, in any media at any time, your name, photograph, voice, likeness and/or biographical information for Longa Games or related purposes without additional compensation to you.
- If you win a Prize, you understand and agree that the Company may, if required by law, provide a third party with details of any Prize claimed by you or on your behalf, or paid to you.
- You agree that the Company has the right to send you promotional messages at any time.
8. PROHIBITED AND ILLEGAL ACTIVITIES
- You agree to comply with all applicable laws and not to access and/or use the Longa Games Platforms or participate in Games in connection with activities that are illegal or prohibited by law, including, without limitation:
- Money laundering and trafficking in the proceeds of crime;
- financing of terrorism;
- illegal drugs and/or illicit drug paraphernalia;
- firearms, ammunition or other weapons;
- pornography and other sexual activities or materials;
- obscene or offensive activities or material;
- Content or activities that promote intolerance, violence or hatred;
- Fraud, scams, pyramid schemes or Ponzi schemes;
- counterfeit materials;
- infringement of the copyright, patent, trademark, trade secret or other intellectual property rights of the Company or any other third party; or
- any other illegal activity or unlawful purpose.
- You represent and warrant that your access to and/or use of the Longa Games Platforms and your participation in the Games is for your personal use and not for your commercial use or the representation of others. Any use by you of the Longa Games Platforms and participation in Games for third parties or for commercial purposes is a prohibited activity.
- The Company owns or licensees all copyrights, trademarks and other intellectual property rights relating to the Longa Games Platforms and the Games, and you will not acquire any rights thereto. You must not, and will be a prohibited activity, to:
- copy, disclose, transmit or otherwise make available or delete or modify any material available on the Longa Games Platforms ;
- reverse engineer or decompile (in whole or in part) any software used in connection with the Longa Games Platforms and/or the provision of the Games (except to the extent expressly permitted by applicable law); or
- remove, obscure or alter any copyright, trademark or other intellectual property rights notice in any material obtained from the Longa Games Platforms or as a result of participation in the Games.
- You further represent and warrant that you will not engage in any of the following other prohibited activities:
- knowingly or recklessly transmit any content (including, without limitation, viruses) through the Longa Games Platforms that will cause, or may cause, harm or harm, to any degree, to computer systems owned by the Company or others;
- hacking, soliciting excessive traffic or altering the functions of any computer system, delivering or forwarding chain letters, "junk mail" of any kind, surveys, contests or otherwise engaging in behavior intended to prevent others from playing the Games or the use of the Longa Games Platforms or any other website, or that is otherwise likely to damage the reputation or business of the Company or any third party; or
- authorize or permit anyone to do the foregoing.
- The Company reserves the right to deny you access to and/or use of the Longa Games Platforms and/or to reject any Entry entirely and/or withhold any Prize if the Company believes that you are accessing and/or using the Longa Games Platforms or participating in Games in pursuit of activities that are illegal or prohibited activities.
- In the event that your account is terminated or blocked or if a registration is rejected due to your participation in prohibited or illegal activities, the Company shall have no obligation to refund to you any registration fee or monetary balance that may be in your account.
- The Company further reserves the right to report such prohibited or illegal activities to the relevant governmental authorities.
- You agree to indemnify the Company against all costs, losses, damages and expenses that the Company may suffer or incur arising out of or in connection with any claim, legal proceeding or demand made by any third party due to or arising out of your access to and/or use the Longa Games Platforms or participate in games for prohibited or illegal activities or your otherwise wrongful or negligent access and/or use the Longa Platforms Games or participate in games.
9. LIMITATION OF LIABILITY
- Your access to and/or use of the Longa Games Platforms and/or participation in the Games is entirely at your own risk and you assume full responsibility for any risk of loss resulting from your access to and/or use of the Longa Games Platforms and/or participation in the Games.
- The Company makes no express or implied warranties or representations that the Services will meet your requirements, will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the software or server that makes them available are free of viruses. or bugs. The Company makes no representations as to the full functionality, accuracy and reliability of the Services or the accuracy of any information obtained by you.
- The Company reserves the right to suspend, modify or delete or add to the Longa Games Platforms any game or software at our sole discretion with immediate effect and without notice. We will not be liable to you for any loss suffered by you as a result of any changes made, modification, suspension or discontinuance of the Services and you will not have any claim of any kind against us in this regard.
- The Company's sole obligation is to pay prizes won in any game to the rightful owners of the winning entries, or to provide a refund of the entry fee in the circumstances set out in these terms. The Company shall not be liable for any loss of profits, special, indirect or consequential loss, suffered or incurred by you (or any holder or owner of an Entry, any person claiming a Prize during the validity period or any other person) that occurs due to the delay or non-payment of a prize, withdrawal from any game.
- The Company will not be liable to anyone for:
- events beyond its reasonable control and expectations (e.g. war, strike, lockout, industrial action, fire, flood, drought, power outage and/or failure or obstruction of any network, broadcast or telecommunications service);
- computer malfunctions, failure of any telecommunications service or internet connection, or attempts by you to participate in the Games by methods, means or ways not intended by us;
- failure or destruction or damage to all or part of the Company's or any third party's computer systems or records (including, without limitation, the Longa Games Platforms);
- any error caused by all or part of the computer systems or records of the Company or any third party (including, without limitation, the Longa Games Platforms);
- delays, losses, errors or omissions in or committed by the postal or other delivery service or by the banking system;
- any other action or event that prevents or hinders the delivery of a valid entry (including, without limitation, the inability of the Longa Games Platforms to display correctly on any device used to view it);
- any loss caused by you, including misuse or unauthorized use of passwords, money lost while playing the Games and failure to keep the Company informed of changes to your details; and
- any loss caused by the failure or malfunction of your equipment or technology or your Internet service provider or mobile network operator, or the equipment, technology, Internet service provider or mobile network operator of any other person or third party.
10. RESPONSIBLE GAMING
- We advocate responsible gambling and take our responsibility in this regard very seriously. Playing Longa Games should be a pleasure and not a vital need, nor an alternative source of income let alone an addiction. We encourage our customers to have fun, but to bet responsibly without exceeding their budget and in a moderate way so that playing remains a pleasure.
- We will strictly follow the guidelines imposed by the World Lottery Association on responsible gambling and monitoring and reporting any suspicious activity.
11. ACCOUNT CLOSURE AND TERMINATION
- You can close your account at any time by contacting the customer service team and asking them to close your account.
- You can stop your participation at any time. However, if you do not log in or access or use your account or make entries for a continuous period of six (6) months, your account will become a "dormant account" and the Company reserves the right to terminate dormant accounts without notice. according to the clause below.
- The Company may terminate, modify or suspend the provision of the Games, access to your Account and/or the Longa Games Platforms and refuse all current or future Entries by you, immediately and without notice:
- if any information you have provided is fraudulently provided or is inaccurate, out of date or incomplete;
- if you violate any of these Terms or the relevant Game Rules;
- for repair or maintenance work or to upgrade or update the Longa Games Platforms ;
- if the Company ceases to offer the Services or Games for any reason;
- if your account becomes a dormant account; or
- for any other reason at the Company's sole discretion.
- Once your account has been closed or terminated for any reason, the Company will return all remaining funds to your account (excluding Mobile Money funds collected or being collected) to the Mobile Money account registered to your account.
- If the Company is unable to return such funds to you, the Company will hold such funds for a period of six (6) months from the date the account was closed or terminated. You may contact the Company at any time during this six (6) month period to claim the funds, which will be reimbursed by the Company subject to verification of your identity and entitlement to funds in accordance with the Company's verification policies. No interest will be payable on the amounts repaid. All funds not collected within this six (6) month period will be forfeited.

- If sent by registered mail, seven (7) days after the time of sending;
- If it is sent by e-mail within twenty-four (24) hours of its shipment; and
- In case of hand delivery, at the time of delivery

We will at all times endeavour to respond to your request or promptly resolve a reported issue. For any legal notice, you will only contact us via the postal and physical address provided.
- Offensive or rude language, as well as malicious or harmful comments, will not be tolerated when contacting our customer support team or discussing our products and services in any media, social network or forum. Any breach of this clause will result in suspension of your Account or any additional action that may be required to ensure compliance. In addition, any act of violence against a representative of the Company is considered an infringement and will be brought before the competent courts and tribunals.
13. APPLICABLE LAW
- These Terms shall be governed by and construed in accordance with the laws ofthe Democratic Republic of Congo.
14. DISPUTE RESOLUTION
- Any complaint or dispute you may have should first be referred to the customer service team for resolution. In the event that the dispute remains unresolved for thirty (30) days since the referral to the customer service team. Either party may submit the dispute to arbitration in accordance with the procedure in force.
15. GENERAL
- These Terms will be amended from time to time by the Company in its sole discretion, and the changes will be posted on the Longa Games Platforms. By accessing the Longa Games Platforms or participating in the Games, you are bound by the updated version of these Terms that is posted on the Longa Games Platforms . If you find the Terms unacceptable at any time, you must promptly discontinue access to the Longa Games Platforms and /or use of the Services and terminate your Account.
- These Terms constitute the entire agreement between you and the Company with respect to your access to the Longa Games Platforms and Services and supersede any prior agreements or understandings between us. In the event of any future changes or updates to these Terms, the most current version of the Terms shall prevail and previous versions shall become void.
- If any provision of these Terms is held to be invalid or unenforceable by or as a result of the decision of a court or other competent authority, you agree that such decision shall not result in the invalidity or unenforceability of the remaining provisions of these Terms.
